Do you need Social Security Disability representation?
How Social Security Decides Your Case
After a person has completed filing an application for Social Security Disability (SSD) or Supplemental Security Income (SSI) the next order of business usually involves determining what conditions, or combination of conditions would qualify a person for disability benefits.
The Social Security Administration has written regulations that govern how disability is determined and developed a 5-Step Process. The 5-Step Process is as follows:
- Are You Engaged in Substantial Gainful Activity?
- How Severe Are Your Impairments?
- Do You Meet the Listing of Impairments?
- Can you do your prior work?
- Can you do any other type of work?
There is an additional requirement that the claimant has been or will be disabled for a period of twelve months.
It is not unusual for people to suffer from a combination of conditions which would prevent all possible gainful employment.
Our disability lawyers have the experience necessary to present the best evidence to an Administrative Law Judge to show a claimant is no longer employable.
